1. OWNERSHIP AND INTELLECTUAL PROPERTY

All content included on this Site, such as invitation designs, templates, graphics, logos, images, digital downloads, and text, is the exclusive property of DearDay Studio and is protected by United States and international copyright laws.

Limited License: When you purchase a design, you are granted a non-exclusive, non-transferable, revocable license for personal use only.
Prohibitions: You may not copy, redistribute, resell, or use our designs for any commercial purposes without express written consent from DearDay Studio.

2. PRODUCT CUSTOMIZATION & ACCURACY

For products involving customization (invitations, stationery):

Customer Responsibility: You are responsible for providing accurate information (names, dates, locations, etc.). DearDay Studio is not liable for spelling, grammar, or informational errors provided by the customer.
Proofing: If a proof is provided, your approval signifies that the design is ready for final production. We are not responsible for errors discovered after your approval.
Color Variance: Please note that actual colors may vary slightly from what appears on your screen due to monitor settings and printing technology.

3. DIGITAL PRODUCTS

If you purchase digital downloads/templates:

Due to the nature of digital content, all sales of digital products are final and non-refundable once the files have been downloaded or accessed.
It is the customer's responsibility to ensure they have the necessary software and hardware to use the digital files.

4. SALES TAX AND PAYMENTS

Sales Tax: In accordance with U.S. state tax laws (Nexus), sales tax may be applied to your order based on your shipping address. The total tax will be calculated at checkout.
Payments: We use secure third-party payment processors. By providing your payment information, you represent that you have the legal right to use the chosen payment method.

5. SHIPPING AND DELIVERY (For Physical Goods)

Risk of Loss: All physical items purchased from DearDay Studio are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (USPS, UPS, FedEx, etc.).
Delivery Estimates: Shipping dates are estimates and are not guaranteed. We are not responsible for delays caused by the carrier or customs.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, DearDay Studio shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our products or website. In no event shall DearDay Studio’s total liability exceed the amount paid by you for the specific product in question.

7. GOVERNING LAW

These terms and any disputes arising out of your use of this Site shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.
